REALLOCATION OF EXISTING MONEY

Political subdivisions are authorized in certain circumstances to reallocate existing money.

1. Temporary transfer for an economic development purpose of money held for a different purpose.


Interfund Borrowing:
Pursuant to IC 36-1-8-4, a political subdivision may authorize the transfer of money to a depleted fund from another fund which has sufficient money on deposit. Any amounts transferred must be returned to the orginal fund no later than the end of the budget year in which the transfer occurs.

Borrowing Utility Funds:
A city or town may borrow existing surplus moneys from a utility owned by the city or town (which in most cases would include water and electric utilities, but not municipally owned sewage utilities)pursuant to IC 8-1.5-3-12 the loan must be used for current purposes and is payable from taxes levied and to be collected during the current and following year. The loan may not be in an amount greater than 50% of the anticipated taxes to be collected and must be repaid on or before thirty days after the last date for payment of such anticipated taxes.

Other Borrowings:
Depending on the nature of the project, other ways to obtain funds may be specifically authorized by statue. Pursuant to IC 36-7-14-24 moneys from the general fund of a county, city or town may be transferred without appropriation, or in the event no unappropriated moneys are available in the general fund, may be transferred from another fund or loaned (in the same manner as other transfers and loans are made) to a redevelopment commission to pay certain project costs incurred prior to the collection of special taxes levied. The amount of such transfer or loan may not exceed $50,000 and must be repaid by the redevelopment commission.

2. Appropriation for an economic development purpose of money originally appropriated for a different purpose.

Additional Appropriations: Political subdivisions have the authority under IC 6-1.1-18-5 to authorize an additional appropriation, limited to available revenues in excess of revenues anticipated in the orginal budget. A political subdivision may also appropriate under IC 6-1.1-18-5 which have become available through the reduction of an existing appropariation. (See IC 36-4-7-8; IC 36-5-3-5) Any such additional appropriation requires a properly noticed public hearing. If the additional appropriation is made from a fund that receives distributions from the motor vehicle highway account ( IC 8-14-1-1) or the local road and street account ( IC8-14-2-4) or revenue from property taxes, approval by the Department of Local Government Finance is required.

"WHERE THERE'S SMOKE, THERE'S FIRE"

There are two types of partners. General partner and silent partner also known as a sleeping partner, is one who shares in the profits and losses of the business, but is uninvolved in it's management, and/or whose association with the business is not publicly known. General partners may have joint liability or joint and individual liabilities depending upon various circumstances.

Regarding civil law, the partnership is a nominate contract between individuals who, in a spirit of cooperation, agree to carry on an enterprise, contribute to it, by combining property, knowledge or activities and to share its profit.

A silent partner is an investor who does not have any management responsibilities but offer capital and shares liability for any losses experienced by the enity. Silent partners are legally responsible for any losses up to the amount of their invested capital and participate in any tax and cash flow benfits.

GARNER'S SPITEFUL ACT

Talk about the law of unintended consequences.

When New Albany plumbing inspector Steve Brodus complained about the conduct of Building Commissioner Eddie Hancock, he didn't expect to lose his own full-time job.

But in fact, Mayor James Garner did reduce Mr. Brodus, and 18 year city employee, to part-time work, which also eliminated his job-related benfits.

No question, change is justified. The question is, what kind?


Inspection was under the control of Mr. Hancock-a 71-year-old former builder whom the Mayor appointed earlier that year, even though he was not a certified inspector.

At that time the state had begun checking all new commercial and industrial construction in the city, after discovering what appeared to be slipshod local oversight. Some of Mr. Hancock's own private building work was under state scruntiny.

The Mayor's explanation for demoting Mr. Broadus-that it makes budgetary sense, because there's so little work for him to do-sounds as thin as cheap plywood!

Mr. Brodus wondered whether "this was happening to him because he was trying to do his job."

What else should he conclude, after being shoved to part-time the day after he issued a second order to stop work on a project being built by Mr. Hancock's brother.

It should come as no surprise if the public concludes there's something wrong here.

We at Freedom of Speech clearly think that what the Mayor has done looks bad and smells bad!

In the past Mayor Garner's effort to justify his actions was a charge-made against Mr. Broadus he had been working for himself while on city time. Of course Mr. Brodus firmly denied this. And our Mayor could not prove it.


So who do you believe?

Mr. Brodus also noted that the Mayor never raised such an issue with him before cutting back his hours.

If the Mayor had proof, he should have produced it. If he didn't, he should have backed off and shut up about Mr. Brodus...Right?

It does show there is some "justice" in our little town called New Albany!
